Cookie Policy

Cookie Policy

It should be noted that the use of cookies on users’ terminal equipment has significant implications for data protection. This is because, through the use of cookies, entities obtain data related to users that can subsequently be used. For this reason, it is necessary to inform users of the use of cookies so that they are aware of the data processing carried out.

VESNA RICHARDSON must carry out a comprehensive analysis of the cookies that, through its website, may be installed on users’ computer devices. Once the purpose of these cookies is known, VESNA RICHARDSON must comply with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), data protection regulations and the recommendations published by the Spanish Data Protection Agency in its Guide on the use of Cookies.

It is necessary to determine that cookies used for the following purposes are exempt from this policy:

  • Only permit communication between the user’s device and the network.
  • Strictly provide a service expressly requested by the user.

It is important to note that VESNA RICHARDSON may use data storage and retrieval devices on recipients’ terminal equipment, provided that they have given their consent after being provided with clear and comprehensive information about their use.

Information regarding cookies must be displayed in accordance with the following requirements:

  • Information or communication must be concise, transparent and intelligible.
  • Clear and simple language must be used, avoiding phrases that could cause confusion or detract from the clarity of the message.
  • Information must be easily accessible.

The use of tiered privacy notices is recommended, i.e. notices that contain information in layers, allowing users to go to those aspects of the notice that are of most interest to them, thus avoiding information fatigue, without prejudice to the fact that all the information is available in a single place or in a complete document that can be easily accessed if the data subject wishes to consult it in its entirety.

VESNA RICHARDSON will periodically review any changes that may occur in the management and use of cookies in order to update the information displayed to users regarding cookies.

4.3.1. Information prior to the cookie policy

In order to comply with the requirements of transparency of information and the obligation to obtain consent, the use of tiered privacy statements or notices is recommended. These consist of providing the user with information in layers, thus avoiding information fatigue.

This system may consist of displaying essential information in a first layer when the page or application is accessed, and supplementing it in a second layer with a page offering more detailed and specific information about cookies.

The following information must be included in this first layer:

a. Identification of the person responsible for the website.

b. Identification of the purposes of the cookies that will be used.

c. Information on whether the cookies are own or third-party cookies.

d. General information about the type of data that will be processed in the event that profiles are created.

e. How the user can accept, configure and reject the use of cookies.

f. A clearly visible link to additional and more detailed information (cookie policy).

This information shall be provided prior to the use of cookies in a format that is visible to the user and shall remain visible until the user gives or withholds consent. With regard to point b), concerning the identification of the purposes of cookies, we would like to clarify that:

  • Cookies used for personalisation purposes, which are chosen by the user, will be considered technical cookies, meaning that the user’s consent does not need to be obtained, but their existence must be disclosed. This consideration will be taken into account provided that the information that may be derived from the user’s selection is not used for other purposes (e.g. for the personalisation of advertising content); in such cases, the user’s consent must be obtained. An example of personalisation cookies that the user can choose is if they can select the language of the website by clicking on the icon of the corresponding country flag.

With regard to point e) of this first layer of information, it must contain:

  • A clearly visible button or equivalent mechanism with the words ‘Accept cookies’, “Accept”, ‘Consent’ or similar text so that the user can consent to the use of all cookies.
  • A button or equivalent mechanism, similar to the previous one, with the words ‘Reject cookies’, ‘Reject’ or similar text, so that the user can reject the use of cookies (except those that are exempt from the obligation to obtain informed consent).
  • As in the previous points, there must also be a button or mechanism that displays or takes the user to a configuration panel that allows them to accept or reject cookies in a granular manner. The button or mechanism for configuring cookies must take the user directly to this panel without having to scroll through large amounts of text and must remain permanently accessible.

In addition, the aforementioned buttons must meet the following requirements:

o Users should not be given the impression that they are obliged to accept cookies in order to browse the website.

o Users must not be clearly pushed into accepting cookies.

o The colour or contrast of the text and buttons (or equivalent mechanisms) must not be obviously misleading to users in such a way as to lead to involuntary consent. For example, it is not valid for the colour contrast in the text in the ‘Reject’ option to make it difficult to read.

The information in the first layer must be supplemented with a configuration system or panel where users can choose whether or not to accept cookies on a granular basis.

In this regard, below we provide the information that VESNA RICHARDSON must select and insert on its website, depending on the cookies it uses, via a header bar or pop-up window:

VESNA RICHARDSON shall provide users with clear and comprehensive information on the use of cookies and, in particular, on the purposes of data processing.

The cookie policy shall provide users with the following information:

  • Definition and general function of cookies.
  • Information about the type of cookies used and their purpose.
  • Identification of who uses cookies. Information on how to accept, refuse or revoke consent for the use of cookies.
  • Where applicable, information on data transfers to third countries carried out by the publisher.
  • Where appropriate, information on profiling.
  • Retention period for personal data or criteria used to determine the retention period.

Below, VESNA RICHARDSON sets out the cookie policy, which must be accessible to users of the website:

In accordance with the provisions of Article 22.2 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE) in force, VESNA RICHARDSON must comply with the obligation to inform about the cookies it uses and their purposes.

This website uses cookies and/or similar technologies that store and retrieve information when you browse. Cookies allow a website, among other things, to store and retrieve information about the browsing habits of a User or their equipment and, depending on the information it contains and the way in which you use your equipment, they can be used to recognise the User.

Cookies are essential for the functioning of the internet, providing countless advantages in the provision of interactive services, facilitating the User’s browsing and usability of our website.
